Terms of Service

These Terms of Service ("Terms") govern your access to and use of TouchScanner — the touch-scanner.com website, the TouchScanner Android application, and any related services provided by EnvyGroup, LLC ("we," "us," "Company"). By using TouchScanner, you ("Tester," "you") agree to these Terms. If you do not agree, do not use TouchScanner.

1. Service description

TouchScanner is a software product for Uniden SDS-class and BCD-class scanners. It includes:

• An Android application providing full control and live audio for supported scanners
• The touch-scanner.com website with product information and the Tester Program signup
• The Tester Program — pre-release access to TouchScanner builds in exchange for feedback (governed by the separate Confidentiality Agreement)

2. Acceptable use

You agree to use TouchScanner only for lawful, non-commercial purposes consistent with monitoring scanner traffic in your jurisdiction. You agree NOT to:

• Reverse-engineer, decompile, disassemble, or attempt to derive the source code
• Distribute, resell, sublicense, or otherwise transfer TouchScanner to any third party
• Use TouchScanner to violate the laws of any jurisdiction (including, but not limited to, laws restricting interception of certain radio communications)
• Remove, alter, or obscure any copyright, trademark, or patent notices
• Use TouchScanner in any way that competes with the Company's commercial interests
• Bypass the Tester Program Confidentiality Agreement or any technical access controls

3. Intellectual property

TouchScanner is the property of EnvyGroup, LLC. All rights are reserved, including but not limited to:

• Patent — TouchScanner is protected by US Provisional Application 64/076,507 and additional patent applications.
• Copyright — All source code, documentation, screenshots, and marketing materials are copyrighted.
• Trademark — "TouchScanner" is a trademark of EnvyGroup, LLC. "Uniden," "SDS," and "BCD" are trademarks of their respective owners. TouchScanner is not affiliated with Uniden America Corporation.

These Terms do not grant you any ownership rights in TouchScanner. You receive a limited, non-exclusive, non-transferable, revocable license to use TouchScanner for personal scanner-monitoring purposes during the term of your participation, subject to these Terms.

4. Tester Program

Participation in the Tester Program is governed by these Terms together with the Tester Program Confidentiality Agreement. By signing up, you agree to both. Either you or we may terminate your participation at any time, with or without cause, with written notice. Pre-release builds you have installed remain functional until they naturally expire, but you receive no further updates after termination.

5. Beta software disclaimer

Pre-release TouchScanner builds are provided "AS-IS", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume all risk arising from installation and use of pre-release builds. We are not liable for any data loss, device damage, or other harm resulting from use.

6. Limitation of liability

To the maximum extent permitted by applicable law, EnvyGroup, LLC's total liability for any claim arising out of or relating to TouchScanner shall not exceed the greater of (a) the amount you paid us for TouchScanner in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100). In no event shall EnvyGroup, LLC be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

7. Changes to TouchScanner

We reserve the right to modify, suspend, or discontinue any aspect of TouchScanner at any time, with or without notice. We may also modify these Terms; if we make material changes, we will provide at least thirty (30) days' notice via email to active Tester Program members.

8. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in Pennsylvania.

9. General

• Entire agreement — These Terms, together with the Privacy Policy and the Tester Program Confidentiality Agreement, constitute the entire agreement between you and EnvyGroup, LLC regarding TouchScanner.
• Severability — If any provision is held unenforceable, the remainder will continue in effect.
• No waiver — Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment — You may not assign these Terms without our prior written consent. We may assign these Terms to a successor entity (e.g., in connection with a merger or acquisition) without restriction.
